DIGITAL NOMAD VISA – WHAT YOU NEED TO KNOW!
Definition
A third-country national who is authorised to remain in Spain in order to carry out an employment or professional activity at a distance for companies located outside the national territory, by means of the exclusive use of computer, telematic and telecommunications means and systems, is in a situation of residence for international teleworking.
In the case of exercising an employment activity, the holder of the authorisation for international teleworking may only work for companies located outside the national territory. In the case of a professional activity, the holder of the international telework authorisation shall be allowed to work for an undertaking located in Spain, provided that the percentage of such work does not exceed 20 % of his total professional activity.
Qualified professionals who can prove that they are graduates or postgraduates from universities of recognised prestige, vocational training and business schools of recognised prestige or with a minimum of three years’ professional experience may apply for the visa or authorisation for teleworking.
Requirements
In addition to the general requirements of Article 62, the following must be accredited:
- The existence of a real and continuous activity for at least one year of the company or group of companies with which the worker has an employment or professional relationship.
- Documentation accrediting that the employment or professional relationship can be carried out remotely.
- In the case of an employment relationship, proof must be provided of the existence of the same between the worker and the company not located in Spain for at least the last three months prior to the submission of the application, as well as documentation accrediting that said company allows the worker to carry out the work activity remotely.
- In the case of the existence of a professional relationship, proof must be provided that the worker has had a business relationship with one or more companies not located in Spain for at least the last three months, as well as documentation accrediting the terms and conditions under which he/she is going to carry out the professional activity remotely.
Visa for international teleworking
- Foreign nationals not resident in Spain, who intend to reside in Spanish territory for the purpose of teleworking remotely for a company not located in Spain, shall apply for a visa for international teleworking, which shall be valid for a maximum of one year, unless the period of work is shorter, in which case the visa shall be valid for the same period of time as this.
- The visa for international teleworking shall constitute sufficient title to reside and work remotely in Spain during its validity.
- Within sixty calendar days prior to the expiry of the visa, international teleworkers, who are interested in continuing to reside in Spain, may apply for the authorisation of residence for international teleworker, provided that the conditions that generated the right are maintained.
Residence for international teleworkers
- Those foreign nationals who are in Spain on a regular basis or who have gained access by means of the visa provided for in the previous Article, may apply for a residence authorisation for the purpose of teleworking remotely for a company located abroad, which shall be valid throughout the national territory.
- The validity of this authorisation shall be valid for a maximum period of three years, unless it is requested for a shorter period of work.
- Holders of this authorisation may request its renewal for periods of two years as long as the conditions that generated the right are maintained”.
